1. Agreement to Terms

By accessing or using Photo Chef AI ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Lifetime License

Upon purchase of a Base Plan ($97) or Innovation Package ($197), you receive a lifetime license to use Photo Chef AI, subject to these terms:

• The license is non-transferable and for individual use only
• You may use the Service for unlimited generations based on your own API quota
• Lifetime access means access for the life of the product, subject to these terms
• We reserve the right to discontinue the Service with 90 days notice

3. API Key Requirements

Photo Chef AI requires you to provide your own Google Gemini API key:

• You are responsible for obtaining and maintaining your own API key
• API costs are separate from Photo Chef AI licensing fees
• Your API key is stored locally and encrypted in your browser
• We never have access to your API key or API usage data
• You are responsible for all API costs incurred through your usage

4. Commercial License

Both Base and Innovation Package plans include a commercial license:

• You may use generated images for commercial purposes
• You retain full rights to images you generate
• You may use images on menus, websites, social media, and marketing materials
• You may not resell or redistribute the Photo Chef AI software itself

5. Refund Policy

We offer a 3-day money-back guarantee from the date of purchase, subject to fair use:

• Refunds are available within 3 days of purchase
• Refunds are subject to fair use - excessive generation activity may void eligibility
• To request a refund, contact us at hello.photochefai@gmail.com with your purchase details
• Refunds are processed within 5-7 business days
• We reserve the right to deny refunds for suspected abuse

6. Prohibited Uses

You agree not to use the Service:

• For any unlawful purpose or in violation of any laws
• To generate harmful, offensive, or inappropriate content
• To reverse engineer or attempt to extract the source code
• To share your license with others
• To circumvent any usage limitations or security features

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

In no event shall Photo Chef AI be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid for your license.

9. Updates and Modifications

We may update the Service from time to time. Lifetime license holders receive all updates at no additional cost. We reserve the right to modify these terms with 30 days notice.
